Our legal team at Morici, Longo & Associates recently obtained a $5.9 million partial settlement on behalf of one of our clients. The client suffered several serious injuries after being struck by a one-ton jib extension that fell from a crane.
The 51 year old man was working on the Fox River Bridge Project along the Jane Addams Memorial Tollway in Elgin when the accident occurred. Based on our investigation, the accident was caused by a defective bracket design in the Terex RT555 hydraulic crane. Our lawyers were able to reach a fair agreement with Hammer & Steel Inc., Kenny Construction Co., Edward Kraemer & Sons Inc., K&S Engineers Inc., and Kenny/Kraemer Joint Venture on January 10th.
Due to the accident, our client suffered fractures to his right tibia and ankle, left femur, patella and tibia, his left clavicle and scapula. He also broke all of the ribs on his left rib cage. His eye socket and cheekbone underwent surgical repair as did his legs and lumbar spine and he was diagnosed with a traumatic brain injury.
The suit continues against crane operator and Terex, the manufacturer of the crane. Terex faces allegations it knew that the system to hold the jib in place had failed repeatedly and resulted in prior fatalities, but failed to issue safety alerts until after our client was hurt.
Lead Trial lawyer James J. Morici, Jr. said, “A partial settlement will guarantee that our client and his family are minimally supported for the rest of his life, but it doesn’t really begin to fully compensate him as we move towards trial against Terex and Imperial Crane Inc. the parties who had the highest level of fault.”
